1. Agreement to Terms By accessing or using our website and purchasing our cookies and cakes, you agree to be bound by these Terms of Service. These terms apply to all visitors, users, and others who access the site or utilize the services of AQUAYSHENA'S RUSTIC EVOLVING LLC. If you disagree with any part of the terms, then you may not access the service.

2. Products and Services These terms apply specifically to the sale of our cookies, cakes, and related baked goods. We reserve the right to modify or discontinue any product without notice at any time. We have made every effort to display as accurately as possible the colors and images of our products that appear on the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

3. Dietary and Allergen Disclaimer Our baking operations prioritize high-quality ingredients. However, our baked goods are prepared in a commercial kitchen facility that may handle major allergens, including soy, dairy, eggs, wheat, peanuts, tree nuts, fish, and shellfish. While we take precautions to prevent cross-contamination, we cannot guarantee that any item is completely free of allergens. Customers with severe food allergies consume our products at their own risk.

4. Orders, Payments, and Cancellations We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address provided at the time the order was made.

Cancellations must be made strictly within the timeframes outlined in our Return and Refund Policy (at least 2 hours prior to scheduled pickup). Please refer to the Return and Refund Policy for full details on issue reporting and resolution.

5. Accuracy of Billing and Account Information You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

6. Intellectual Property All content included on this site, such as text, graphics, logos, images, and software, is the property of AQUAYSHENA'S RUSTIC EVOLVING LLC and is protected by copyright and intellectual property laws.

7. Limitation of Liability In no case shall AQUAYSHENA'S RUSTIC EVOLVING LLC, our directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind arising from your use of any of the service or any products procured using the service.

8. Governing Law These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Florida.
